Welcome to the Gang! We're so happy you're here. This document is our official list of "clubhouse rules." By using our website (thegreenhousegang.com) and shopping with us, you're agreeing to these terms. We’ve tried to make them easy to understand, but they form a legally binding agreement that protects both you and our nursery.

 

1. The Official Handshake (Agreement to Terms)

 

(The Gist: By using our website and buying our awesome plants, you're agreeing to follow these rules. If you don't agree with them, you can't use the site.)

This website is operated by The Greenhouse Gang Plant Nursery LLC. Throughout the site, the terms “we”, “us” and “our” refer to The Greenhouse Gang Plant Nursery LLC. Your use of this site and/or purchase of products from us constitutes your agreement to all terms, conditions, policies, and notices stated here. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

 

2. Your Clubhouse Membership (Your Account)

 

(The Gist: If you create an account with us, you're in charge of keeping your password secret and making sure your info is accurate. You're responsible for everything that happens under your account.)

You may be required to create an account to access some features of our site. You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account or password. We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in our sole discretion.

 

3. Shopping with the Gang (Products & Sales)

 

(The Gist: We do our best to make our photos and descriptions accurate, but please remember that plants are unique living things! We reserve the right to change prices or cancel an order if needed, but we'll always let you know why.)

We have made every effort to display as accurately as possible the colors and images of our products. We cannot guarantee that your computer monitor's display of any color will be accurate. All descriptions of products or product pricing are subject to change at any time without notice, at our sole discretion. We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order.

 

4. Our Groovy Content (Intellectual Property)

 

(The Gist: Everything you see here—our logo, photos, and witty words—belongs to us. We worked hard on it, so please don't use our stuff without our express written permission!)

All content included on this site, such as text, graphics, logos, images, as well as the compilation thereof, is the property of The Greenhouse Gang Plant Nursery LLC or its suppliers and is protected by copyright and other intellectual property laws.

 

5. Playing Nicely in the Sandbox (Prohibited Uses)

 

(The Gist: Please be a good human. Don't use our site for anything illegal, shady, or harmful. Be cool!)

In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service.

 

 

6. When Things Go Wrong (Limitation of Liability)

 

(The Gist: We strive to run a fantastic website, but we can't promise it will always be perfect or error-free. To the fullest extent the law allows, we are not liable for damages that might come from using our site or products.)

We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free. In no case shall The Greenhouse Gang Plant Nursery LLC, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, arising from your use of the service or any products procured using the service.

 

7. The Legal Backyard (Governing Law & Disputes)

 

(The Gist: If we ever have a serious disagreement, it will be handled by a neutral third party (an arbitrator) according to the rules of the state of Florida. This keeps things simpler and avoids a big courtroom battle.)

These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the State of Florida. Any dispute or claim relating in any way to your use of this site, or to any products sold or distributed by us, will be resolved by binding arbitration, rather than in court.
